Description:

State laws and taxes governing trusts vary widely. This program will discuss the advantages and disadvantages of other state laws for creating new trusts and/or moving existing trusts to non-resident states. Current trends in trust and estate planning will be reviewed, detailed examples of changing jurisdictions (including roadblocks and risks that may not be readily apparent), and the tax implications of moving trusts will be discussed.

Jeff Scroggin has been in practice for over 35 years. He has focused on providing solutions-based, practical estate planning, tax law, transactional, and business representation. Mr. Scroggin received his education from the University of Florida, earning his accounting degree in 1974, a Juris Doctorate in 1977, and an LL.M in tax law in 1979.

Mr. Scroggin is a member of both the Florida and Georgia bars and has affiliations with numerous councils and societies in the Atlanta area. Mr. Scroggin has been named a Georgia "Super Lawyer" and Five Star Wealth Advisor by Atlanta Magazine. He is Founding Editor of the NAEPC Journal of Estate and Tax Planning and is a prior Co-Editor of CCH's Practical Estate Planning. Mr. Scroggin is author of over 200 published articles and is a nationally recognized speaker.

Thomas M. Forrest, CPA, AEP

Thomas M. Forrest, CPA, manages the Charles Schwab Bank Personal Trust Services Division in Wilmington, Delaware. Before joining Schwab, Tom was President and CEO of U.S. Trust Company of Delaware; he joined the company in 1999 and opened the U.S. Trust office in Delaware in 2000. Previously, Tom served as Vice President and Manager of the Delaware Personal Trust office for First Union Trust Company, N.A. Before holding that position, Tom was Vice President and Manager of the Trust Tax and Financial Planning Division at Wilmington Trust Company for 18 years.

Tom is a member of the American Institute of CPAs, the Delaware Society of CPAs, the Delaware Estate Planning Council, the Philadelphia Estate Planning Council, the Society of Financial Service Professionals and the Wilmington Tax Group. He serves on the boards of the Mary Campbell Center Foundation and Autism Delaware.

During the course of his career, Tom has served as President of the National Association of Estate Planners and Councils; President of the Delaware Estate Planning Council; President of the Bank and Trust Tax Association of Mid-Atlantic States; Treasurer and Chairman of the Tax Committee of the Delaware Society of CPA’s; board member of the Philadelphia Estate Planning Council; and treasurer and board member of the National Conference of Christians and Jews, Delaware Chapter.

He assisted the IRS with the development of fiduciary income tax returns on magnetic media and, under his direction, Wilmington Trust Company became the first bank in the country to file fiduciary income tax returns on magnetic media.

Tom has lectured on a variety of tax and estate planning topics to professional groups nationwide, including the National Graduate Trust School, the ABA Tax Compliance Seminar, the Financial Planning Association, American Bar Association Tax Section Meetings, the Pennsylvania Bar Institute, the Bank Administration Institute, and The National Association of Estate Planners and Councils.

Tom graduated from the University of Delaware in 1982 with a bachelor’s degree in Accounting and from Widener University in 1985 with a master’s degree in taxation. He received the IRS Enrolled Agent designation in 1985, then became a Certified Public Accountant in 1986 and an Accredited Estate Planner in 1995. He received the National Association of Estate Planners & Councils 2005 Distinguished Accredited Estate Planner award.
